When you tick the government officials (or even the clerk that works for them), you can't expect them to bend over in either direction to help you. I agree with some of the others.

It would be better to comply, for now, and then spend your time and money fighting for the right to use your property as you desire.

...Just my 2 cents.

My city hates RVs and any camper taller than a 6ft privacy fence, but you have their blessing to park cabin cruiser size yacht on a trailer on your property (with current license) , as this is a boating city with over 400 miles of canals. It all depends on your neighbors and if they squawk to code enforcement about your camper. A 8ftx 20ft cargo trailer used in a lawn service, parked in the side yard would be ignored, but any size travel trailer is not allowed.
That said, Is a cargo trailer legal? Is a commercial trailer legal? if so, put a sign on the camper- like, "Bob Henry Enterprises", take out a business license and tell the court- it's used for commercial purposes. That ploy may work.

My area is similar. You must park your trailer behind a fence.
(If you go somewhere, when you return,the RV is not to be on the street or in the front yard for more than 72 hours.)

That might be something that Bob could check into. Maybe he would be legal if there was a view-blocking fence around it.

Bob,
Don't forget to check with your State University that has a law school. Most offer free legal advice and representation. You need to get some law students to pick up your cause to bend the ear of a law professor to take your cause. You already are a retired tax paying resident of your state. Are you a veteran also? You can make quite a compelling case for yourself. I'm 57 with a disabled wife, Tiny House living is our retirement plan.

Thanks to one of my buddys above I was enlightened to ucc 1-306 a rather unusual defense that has to be googled to even begin to try and understand it. I have invested about 14 hours reading everything I can find on it and feel it is my only out. They have falsified facts on the complaint and have chosen to ignore state law so this may be an out for me. Any lawyers in the house that would be willing to give me 20 minutes of advice on this defense ?

Thanks for the link Stacie- the tiny house village in Eugene looks nice. If you ever go into an Ikea store and look at their furnished small spaces it would amaze you what you can do with 250-300sf.
Lawyers probably won't help, Bob- they only do what they know how to do. They are agents of the court- compare it to asking a police officer how to beat a speeding ticket, good luck! I would be surprised if it is even taught the W/O prejudice defense in law school. Irwin Schiff knew the tax code and how the IRS was not following it's own laws- like illegal bank account levy- he is in prison right now. Many people in the courts told him he was right- but they couldn't allow him to have a fair trial.

Well I have reports that Operation pocket change had a wrinkle. It seems since the fines will not be levied until a decision has been made they can not apply them to the fine so they are sending them back. I think that's even funnier they get to pay to mail them back and everyone can put the pocket change back in their own pockets.

To all who helped in this show of support thank you again. Court is in 21 days ! :thumbsup:

Well tomorrow is the big day. By this time tomorrow I will have been to court on my most dastardly crime of trying to be a legal homeowner. A citizen with a legal roof over his head wow what a concept. Have a prepared statement to read, if allowed, that will show the judge this has been a 2 year plus project and not just a flight of fancy. I did get some legal advice from a out of county lawyer who happens to also be on that county's zoning board. He says if we want to try I can ask for an exception for a service business. This DOES fit into their guidelines for their industrial corridor rules. I am thing about asking for a construction estimating service office as this is what I do but they may retaliate with a higher "business" tax rate on the property. Oh well that can be decided tomorrow after court.
