General Discussion about almost anything Teardrop or camping related

Postby BrianB » Mon Feb 14, 2005 6:37 pm

angib should get in on the game. Just burn all of his plans to a disc and put them on ebay. It's nearly 100% profit. I see these discs are going for between $10 and $15 dollars + $5 shipping.

Another thought would be to get a copy of the CD and post it on a website for all to have and share for free. I'll donate the web space.

The easiest way

Postby Guy » Mon Feb 14, 2005 7:10 pm

Okay you guys want a way to really stop this guy and others of his ilk, then here it is.

Roly or Grant file a federal copyright action for about 100 dollars. Claims under the federasl copyright act are grantred what is called statutory damages. That means they do not have to prove how much they were damaged(which is really hard to do) rather they are awarded damages up to 500,000 dollars for each separate infringement ie. each time their photos were used on ebay or any cd rom. The only measure was how wilful the infringer was, in this case that is very easy to show since he or she took the photos from someone else's site and reused them for profit. Also under this act attorney fees are also awarded by statute.

Then a subpoena is sent by mail to ebay in CA. Within 30 days the must provide a record of all trtansactions to you and all of his vital statistics, ie name, address, bank accounts and those of his buyers. [/u]

I was wondering when you were going to weigh in on this issue....

Love you Denza

Postby Guy » Mon Feb 14, 2005 10:40 pm

Love you Denza. I was going to post this on Super Bowl night but the broohaha seemed to die down. I have been so occupied with the teardrops4vets project I started that I forgot about it and a lot of other things in the meantime.

The teardrop4vets is a charity similar to Habitat for Humanity except that we do not charge the vets anything and they build their own, under guidance, and get to keep it for free. Hope the Marine in you appreciates the huge benefits to be derive by this.

p.s. Why Denzagrad was waiting for me to Chime in is because he knows that I am a retired copyright lawyer with 25 years at the bar. Retired is the kind word, actually I am disabled now.

"Regarding that letter;
All I really got to do, was choose questions from a few different categories and then simply list the six item numbers. Their form didn't ask me or let me type in anything else.
Maybe Grant is better versed on how to get to the top with them boys at Ebay?"

If you go to that page I listed - http://pages.ebay.com/help/contact_inli ... oblem.html - and highlight the closest possible infringement in each of the three boxes and hit "proceed" or "continue" (whichever it is), another page will come up and on it is an "E-mail" button (the first one I'd seen on eBay!). Hit it, fill in your e-mail address, and start typing in the box under "coments and concerns" ... something like that! Don't worry about the size of the box - just like here, you can get an awful lot of info in there!

That was at 4:00 this morning and I'd been following dead-end leads and fighting their un-cooperative server for what seemed like hours. Sick, couldn't sleep, so thought I'd try to find something I could take action on.

Good Luck, and ...

CHEERS!

The guy is getting desperate now and I'm sure it's him that is bombing my web site trying to use up my band width and has been there all afternoon. Looks like he has a program that hits all the pages one after another. I shut the site down while making some changes so anyone trying to view my site should know it's just temporary.

Using a webwhacker

Postby Guy » Mon Feb 14, 2005 11:30 pm

Denny he is probably using a web whacker or other device to hit all your pages. You can ping him back an actually get his internet address. You can also call your internet provider and they can tell within 3 minutes who it is and report his activity to his web provider who will drop him like a rock.

I like the idea of teardrops for vets, sounds interesting. :applause:

Here's a question for the code, HTML, script people.
There was talk a while back about embedding a code where a window would pop up with a message saying, "Don't Even Think About It" or "Contact Website Owner For Permission To Obtain Images" when a visitor would right click on an image.
Having said this, would that be useless against someone simply using a screen shot or screen hunter program to copy an image with this type of embedded code?

Yes, it's useless if someone has a screen capture program. I think you'd have better luck with a watermark.

All the code does is disable the right click feature of the mouse. If you go to the tool bar and use the edit tab, you can still copy the information. I use a similar code on my ebay pages (no, I don't sell teardrop plans  ), to keep people from stealing my images, but I still find them on other auctions from time to time.

Ok,
I've got another question...which should help out many of us.
Obviously there's got to be more than just putting the "C in the circle" copyright mark on an image, right?
What steps must one take to follow through with to get an image copyrighted?
What about getting a design or a set of plans copyrighted?
