Recovered VW Insurance Claim~IT'S UP FOR AUCTION! 12/18~

Things that don't fit anywhere else...

Postby steve smoot » Thu Nov 19, 2009 9:59 am

I would say the restoration shop owns the van 100% free and clear, as they do have a current clean title. It really makes no differance how they got the title, as long as they got from the state.

I am basing this on what happened to us last summer. We had a Pontiac Convertible up for sale. A dealer ask us to consign with them for 30 days, so we did. They sold the car 3 days later, but failed to tell us untill we called about picking it up. They kept our money and we lost our car.

The State told us that we could not get our car back from the folks that now own it, because they have a clean title. The dealer that took us to the cleaners is now serving 6 years in prison, but we lost our car and the money.

Title washing has been a problem for years and still is.

A car is flooded in the hurricane "Whatever" and is deemed a total loss by the ins. co., it is sent to a scrap yard with the title.

Car interior is removed cleaned, dried, and electronics are dunked in alcohol and then dried. Meanwhile the car is "sold" in a state that doesn't have the same laws for totaled car. The title is sent to new state of sale and then the car is sold again in another state., after 2 or 3 transactions the title is clean and by now the car is too. The title and car end up at some auction and VIOLA you have a used car on the road again.

the 17 digit VIN was supposed to stop this, but it hasn't. Carfax only works if the Insuring company reports it to them.

This is a problem for the current owners who think they have a clean title.
If later they have an accident, their ins. co. may not pay--it's already totaled.

In a stolen and recovered--it always goes to the last legal owner. Someone always gets screwed and it is usually the last owners who are the least likely to know it was stolen--and they usually have the most invested.

GREED somewhere in the chain is the cause for this mess.

Well, here's a similar story with a happy ending that was in our paper Saturday. :applause: :applause:

THE TENNESSEAN

The 1965 Corvette was worth maybe $2,200 when a thief stole it off Lower Broadway 39 years ago. The rightful owner will drive it back home this week, worth 30 times what he lost, after it was recovered nearly four decades later in Arizona.

Chance Mayfield parked the convertible, Nassau blue with a white top, on Lower Broadway and went to the honky-tonks in November 1970. It was a great night at the Broadway Barn, he said, until he walked out to the parking lot and the like-new muscle car was gone.

"That ruined my night," Mayfield said with a chuckle.

The pain of losing the spotless car was already long forgotten when he got a phone call this summer from a detective who said his car had been found. Once he got his mind around what car he was talking about, Mayfield thought someone was playing a prank on him.

After four or five years passed with no sign of the car, Mayfield figured he'd never see it again. But dreams, he said, do come true, and on his 68th birthday he got word that court cases with the most recent owner had been resolved.

The completely restored Corvette, which looks like it spent years as part of various collectors' stock, is now his to take home. He's taking a trailer out to Arizona and he'll bring it home to Putnam County -- about two hours east of Nashville -- next week.

The car was discovered when a collector, who bought the car for about $65,000, took it to the department of motor vehicles for an inspection. The inspector ran the serial number through the National Insurance Claims Bureau, and it came up stolen from 1970.

Of all the things that seem unbelievable about this case -- that nobody checked the car against the insurance database before this year, or that the car looks better than ever -- most amazing to the detectives involved was that the original 1970 police report was still sitting in an archive box. Mayfield's insurance had lapsed just before the theft, so he never got a paid claim for it. The Metro police clear their stolen car cases of the national crime database every six years or so. That piece of paper was enough to determine the car belonged to Mayfield.

"It helped me a lot because it helped me verify Mr. Mayfield's story," said Detective Mark Wagner of the Scottsdale, Ariz., police department. "We couldn't believe it still existed.

"When I called Nashville to tell him we found this car and the detective stopped laughing, he said he'd check the archive, and there it was."

Oldest case solved

Metro car theft detective William Dillon took the call, and says it's definitely the oldest case they've resolved. Detectives tracked the car back to California and then to New Jersey in 2000, and the business that sold it has since closed.

"We'll never figure out who stole it in the very beginning," Dillon said. "It's just an old theft that will actually come to a conclusion."

An old theft with a lesson: "Just because you put your car (behind) you as stolen, don't think we won't recover it sometime," Dillon said

I guess the key to him getting it back was no insurance claim. Otherwise the insurance would have owned it. See, sometimes it's good to not have insurance!

Ouch, feel sorry for the guy that spent $65,000 for that vette. So I wonder is he just out that money or what?

Les, I have heard of them doing that with new cars too. Up in North Dakota, there is a river that floods every couple years, and they say to watch out for good deals on new cars, because the car lot gets flooded, they clean the car out and ship it off someplace else to be sold as new.
If I could shut my brain off, I could save myself alot of time, money and effort.

Why sell it this way? Seems like a second rate and little known site? Why not go high profile press release and then eBay? There's not even a write up on it??

I know it!! I was shocked to see it on there. Although insurance companies use Copart all the time. I'm thinking they just don't realize the market for this VW. OR they just want to get rid of it. hummmm?????

It sure is nice!!

I'm just now learning how Copart does business after living up the street from them forever seeing cars going outta there every week. They sure do get um sold!!

The banner add is not there anymore but when I first signed onto their home page, their banner add advertised "The VW bus that was stolen in the 70's and written up in The Wall Street Journal UP FOR AUCTION" I'm assuming they meant the same one. Now that you say that, I'm thinking it might not be the exact one but maybe the same year. It led me to believe it was the same exact one. hummm???

I was just so surprised to see it there. Maybe I'm wrong to think it's the exact one. I'm not so sure now. That is how they advertised it.

Edit: I just sent an e-mail to the manager of the Copart that has it for sale asking if it is the exact van. Waiting for reply.....

I just read this article and comparing the photos...it looks exactly the same as the Copart's auction page.

I'm still thinking it's the same exact van.
