if the driver's bonded, or the service company's bonded, you should be able to recover damages for acts done by their personnel on company time.
You really do need to consult an attorney.
After a lot of back and forth with the insurance company they are paying the bills. Their legal department spent 2 weeks deciding what to do. My guess is they had to pay, so they did.
