With some law firms, the first visit is free. You can call around to find one like that. With that first free visit, they will tell you whether it is worth taking the company to court or not. Lawyer fees could eat up any judgment you get pretty fast. Please remember that most large companies and corporations have lawyers on staff; so, going to court is no skin off their backs; but it could be even more hazardous to your wallet than the vet bills. However, during the free visit, the lawyer may be able tell you if it is worth going it alone in small claims court. (The $ amount for small claims court may differ by state.)

Thanks Eunice for the thoughts. Bailey is making some progress and we are happy for that. She's been eying the couch. That was her favorite place to lounge. But she is not to try and jump or do any steps so we have the cushions flipped up. It's the little things that you notice.

Sharon....you are right with the lawyer advise. I will look for a free consult and test the water. I should know in a few days what they are going to do. Then I will decide. I'm not a fan of law suits but I can't afford to let this much money go without an effort to recover it.

If you think about it this way, if he ran over your child instead of your dog, do you think they would be responsible for paying for the hospital bills? Yesiree!! The company HAS to have general liability insurance and it does cover property damage and he ran over your property (your animal) and caused some serious injury. They are liable - plain and simple.

If you contact the company again, and I think a visit would really make them take you a lot more seriously, I would bring them a copy of all your bills to date and let them know that this has to be taken care of immediatly or you will have no choice but to go ahead and pursue legal action.

It might just take a threat letter from an attorney to get this settled. But, don't let it go too long - get something going soon. Good luck and hugs for Bailey!

I wanted to tell those that followed this thread what has happened since I posted this story. Bailey has made great strides at getting better. This dog wanted to live. Her lung healed in about 2 weeks. Then the skin on her stomach died from the trauma of the tire rolling over her. They removed a large dead section of skin and hooked her to a vac machine that helps in generating new skin. Two weeks ago they closed her up without having to do a skin graft. We believed we were done. No so. She got a serious infection that we are just now getting over. She is getting around good and is very happy when she is home.
After a lot of back and forth with the insurance company they are paying the bills. Their legal department spent 2 weeks deciding what to do. My guess is they had to pay, so they did.
We may rename Bailey, Ferrari!

Glad Bailey is getting better, sorry the idiot who hit her has gone unscathed. He should suffer 10 times the pain that he inflicted for his absentminded negligence. Give the pup and extra biscuit now and then to let her know that you appreciate her hanging in there.......

That expensive, huh?! It's a good thing that the insurance company is picking up the tab. Still, there is Bailey's suffering and your ordeal....

What a nightmare!

I almost didn't open this thread because I get so upset reading about people losing their dogs. But I'm very glad to read that Bailey is doing well.

God bless Bailey and you and your wife. My sympathies for the emotional toll this took on you and your wife and having the stress of it compounded by the massive bills.

The company ought to also pay to have a remote-controlled gate installed to protect your pups, and you, from their drivers.

So glad to know miracles still can happen. Aren't vets a wonder?

We recently ... the Saturday before Thanksgiving ... lost a kitty. She was 13, and what we thought was pneumonia turned out to be malignant. Our vet was wonderful, and we were able to prevent her from suffering a lengthy illness.

But she just fought through each bad event. We then thought OK we are over the hump. Now this time it seems to be true. She is motoring around pretty good and even has been going up and down the steps to go out side on her own. It is truly a blessing. The Vet Hospital has been unbelievable. Never have we been somewhere that you can tell each person working there loves their job.
