So the facts are as follow. Wednesday (23 May) I go to work @ 8;00 pm. with Pete the manager who I know is on notice for the way he treats the help, manager. I tolerate him as I need the job. Well I know we never get out of the building until after 3:00 with Pete at the job. I usually work 7-2:30 shift at night. Well Pete clocks us out because we work late and supposedly the computers go down because it's late. :? leaving the manager to over ride the computer and I ask what time he clocked us out. He says 3:20. OK! and as we walk past the frosty machine where the clock is and it says 3:35. :thinking: Something isn't right. Well I left it go until this morning (end of shift 5/28.) when Lori a very good manager is working and we can talk with her on very good terms. Well Lori this morning checks the computer log and see's a troubling site. HER time has been edited as well. Then she checks mine and see's where Pete who said I was clocked out by him at 3:20 is in fact checked out at 2:20. We never get out on Pete's shifts until after 3:15. Pete is in real trouble now as he did this to the other three workers as well.

So what I thought was an only 15 min working off the clock is actually a 1.15 off the clock work loss. Pete is presently on probation but we think he will be out of a job now. :(

Sounds like he was trying to do what he felt was a "good" thing for the company by reducing operating costs, but being honest is always the best way to impress the company owner and keep your job, Pete must not have known this.

I don't think I would be sad for Pete... :thinking:

Good thing you were able to speak with another manager about your concerns.

Waiting for "someday" will leave you on your deathbed wondering why you didn't just rearrange your priorities and enjoy the time you had, instead of waiting for a "better" time to come along...

I never knew working for Wendy's was going to be so hard and fast paced. But closing has it's challenges and Pete is a hard driver but ripping off the employees is not the right thing to do. @ 7.25 I earn it but to straight out lie and cheat and still act like your mean to the employees is wrong. Lori and Vern always get us out on time and treat us fair. Lori & Vern always give us perks and that greatly helps. getting to bed @ 3:00 is bad enough but 4:00 and ripping from the worker to make your employees working hours look good is wrong. Often I get only 4 hrs sleep while starting my next job is hard. I am ready to sue but only after I get that time sheet write out. :x

I'd say he was trying to do what would be best for him. Cheating workers and putting the company in jeopardy by violating federal law is not the way to do a good thing for the company. In the long term The manager needs to either learn a lesson or get some training, because hs instincts are wrong.

Many years ago, we were having to a lot of work "off the clock". When one of my coworkers left, he said he was giving us a gift.
Sure enough, about 2 weeks later, Wage and Hour showed up based on an anonymous complaint and pulled an audit and interviewed everyone in the department. I wound up getting reimbursed for about 400 hours of overtime.

You should not have to sue, the government will do that for you. I would recommend keeping a log of when you clock in or out, it may be needed in the future.

I agree with 48Rob, honesty is the best way. I was always brought up the integrity is not negotiable.

Document, document, document. Kept a log book in your car and write down every day....in, out, and break times. A paper trail is your best friend.

Photographs of clocks and time crards are easy too thanks to smart phones....

I went into work today on my time to question the next up and was told they fixed THAT TIME in ? but she also said "You Don't Want To Go Their???? Whats up with that statement. I didn't ask but next time I work with this manager I will watch his action. Then make the call as stated by Shadow Catcher.I spoke to my second job boss and he seems to think that Michelle who is above PETE said "You Don't Want To Go Their" means she would have to take Pete's place if he was removed and that it would not be good for me. This is then a threat maybe????. This is not looking good if we are correct.

I just realized that while off the clock this man was actually yelling at us to get the work done. Not me per say but the other three personnel who were sitting around in the lobby while I was working finishing up the pots & pans, Floor needing mopped and frosty machine needing cleaned. When I work with the two other managers we always get done no later then 2:35 am.

I'd be looking for something else to do. It sounds like there are some serious ethics problems in management. Ever think of opening your own shop? A little creativity and you'd be surprised what you can make a buck doing.

Call it in. Not only is that manager stealing from you, but it's a federal offense under FLSA to even ALLOW an employee to "donate" time.
The more stuff I take along, the more time I spend taking care of my stuff!

Before you bring the government in because of what a lowly manager does, go straight to the top of the company. Write a letter to the president of Wendy's and tell her what's happening.

As a manager who does payroll regularly, I can confidently say that either way, fudging for the employee or for the company, is absolutely illegal and immoral. The only solution is to be truthful at all times, no matter what the truth may look like...

It's a pain the the backside, but documentation can/will be your friend. Have co-workers independently do the same. I require the employees that I manage keep personal records and documentation of their daily activities. There's nothing quite like coo-berating evidence if a jury gets called out. Unfortunately we live in a CYA world and this is one way of keeping yourself out of trouble and/or having proof if you need to make a claim yourself.
